The Personal Data Protection Law (KVKK) entered into force when it was published in the Official Gazette on 7 April 2016. In short, KVKK is a notice on how the information of you, our valued customers, is processed by NetVay and what it is used for.
This Privacy Notice has been prepared by NetVay IT Services (NETVAY İNTERNET VE BİLİŞİM HİZMETLERİ TİCARET SANAYİ LİMİTED ŞİRKETİ), in its capacity as data controller, to inform you about the processing of your personal data. This English text is provided as a courtesy translation; in the event of any discrepancy, the Turkish version prevails.
01 Purposes of Processing Personal Data
Pursuant to Articles 4, 5 and 6 of KVKK, your personal data is processed in accordance with the following principles:
- Being in compliance with the law and the rules of good faith,
- Being accurate and, where necessary, up to date,
- Being processed for specific, explicit and legitimate purposes,
- Being relevant, limited and proportionate to the purposes for which they are processed,
- Being retained for the period stipulated in the relevant legislation or required for the purpose for which they are processed.
In accordance with these principles, your personal data will be processed in connection with NetVay's activities listed below.
Personal data processed within this scope is retained for 5 years as required by the relevant legislation and, if neither party brings any lawsuit within this 5-year period, is destroyed within 90 days following the expiry of the 5 years.
NetVay's Activities
- Providing hosting, server (VDS, VPS and physical server) and data center services,
- Providing domain name registration and management services,
- Carrying out order, contract, billing, activation and technical support processes,
- Delivering and improving services through management panels and software it has developed itself.
02 Transfer of Personal Data
Pursuant to Articles 8 and 9 of KVKK, your personal data may be transferred, within the purposes listed above and within the conditions and purposes of processing personal data, to third parties deemed necessary for NetVay's activities to continue. These persons may include program partners, cooperating institutions, suppliers, managers, legally authorized public institutions and organizations, and legally authorized private-law persons.
03 Method of Collecting Personal Data and Legal Basis
Your personal data is collected by NetVay through the following channels:
- Website registration and application forms,
- Website contact forms,
- Website support forms.
Through these channels and based on different legal grounds, in accordance with the basic principles set out by KVKK and within the personal data processing conditions and purposes stated in Articles 5 and 6 of KVKK, your personal data may be collected, processed and transferred for the purposes stated in this Privacy Notice, so that NetVay can continue its activities.
04 Rights of the Data Subject
Pursuant to Article 11 of KVKK, everyone has the following rights by applying to the data controller:
- To learn whether their personal data is processed,
- To request information if their personal data has been processed,
- To learn the purpose of processing their personal data and whether it is used in accordance with that purpose,
- To know the third parties to whom personal data is transferred, in Türkiye or abroad,
- To request correction of personal data if it has been processed incompletely or incorrectly,
- To request the deletion or destruction of personal data within the conditions stipulated in Article 7 of KVKK,
- To request that the operations carried out pursuant to items (5) and (6) be notified to the third parties to whom the personal data has been transferred,
- To object to the occurrence of a result against the person by analyzing the processed data exclusively through automated systems,
- To request compensation for the damage if they suffer damage due to the unlawful processing of personal data.
05 Application and Contact
If you apply through the NetVay support system regarding your 9 rights stated above, a response will be given within 15 (fifteen) business days at the latest, depending on the nature of your request.
